In a 6-3 decision written by Justice Clarence Thomas, the court’s conservatives overturned a Trump-era ban on bump stocks, saying a bump stock does not convert a semiautomatic rifle into a machine gun.

The Supreme Court justice, already in hot water over his choice of house flags, was secretly recorded saying he doesn’t believe the ideological divides in America can ever be bridged. “One side or the other is going to win,” Alito reportedly said, going on to seemingly endorse a pointed call from liberal activist documentary filmmaker Lauren Windsor — then posing as a conservative — to “return our country to a place of godliness.” “I agree with you, I agree with you,” Alito said, per Windsor’s audio.

Hunter Biden’s daughter testified that she never saw her dad do drugs but knew he was “struggling with addiction,” per reports from the Delaware courtroom where the president’s son is being tried for a gun possession charge. Naomi Biden could not identify exactly when Hunter’s drug problems worsened. “After my uncle died, things got bad,” she said, referring to Beau Biden’s death.

On its first day of deliberation, the jury deciding Donald Trump’s fate in the Manhattan criminal court went home without a verdict Wednesday. While the jury wasn’t exactly expected to come to a decision in a single day, it’s a signal to both the prosecution and the defense that the case wasn’t so convincing — for either side — that it was open-and-shut for the jurors. Deliberations will continue on Thursday.

Justice Samuel Alito sent a letter to Sens. Dick Durbin and Sheldon Whitehouse on Wednesday telling them he won’t be recusing himself, as they requested, for Supreme Court cases pertaining to Jan. 6 or the 2020 election. Alito, who’s wrapped up in a controversy over his wife flying controversial flags connected to Jan. 6 rioters and the Christian nationalist movement, said his wife is a private citizen who decided on her own to fly those flags. A “reasonable person,” Alito said, would conclude that his wife’s flag practices “do not meet the applicable standard for recusal.”

Justice Clarence Thomas was back at the Supreme Court on Tuesday after a still-unexplained absence the day before. He was present for oral arguments on a case about the Capitol riot, despite calls for him to recuse himself from Jan. 6-related cases over his wife’s involvement in questioning the 2020 election results.

Justice Clarence Thomas didn’t attend Monday’s Supreme Court session — and the court isn’t saying why. Thomas still plans to participate in the cases being heard, Chief Justice John Roberts said. Multiple outlets noted it’s highly unusual for the Supreme Court to not give a reason for a justice’s absence.
