Subscription Agreement Terms and Conditions

1. Duration. The Star offers subscriptions of differing durations. We may offer introductory rates or promotions with special pricing in addition to our standard monthly and annual subscriptions. Introductory rates and specially priced promotions are of limited duration with the special rates or prices applying only to the period of the subscription as disclosed in the sign-up process. If you select a monthly subscription, your subscription will begin on the date you sign up and will automatically renew each month until you cancel it. Renewals will occur on the same day of each month as your original sign-up date, except in months in which that date does not exist, in which case your subscription will renew on the last day of that month.

If you select an annual subscription, it will automatically renew for additional one-year periods on the anniversary of the date that you sign up until you terminate the subscription. Once you complete your order we will send you an e-mail confirming your subscription order together with the applicable automatic renewal offer terms, cancellation policy, and instructions on how to cancel.

Your subscription is effective when you pay the subscription fee and any applicable taxes; access is available immediately. You can access your subscription by logging into your account directly on the Site.

2. Fees. The fee for your subscription (and any applicable taxes) will be disclosed to you in the sign-up process. We reserve the right to change the fee for a subscription at any time as we may determine in our sole and absolute discretion, provided that we will notify you between 30 and 60 days in advance of any change. Changes in fees will apply on a prospective basis only. If you do not agree to the price changes, you have the right to reject such changes by cancelling the subscription in accordance with Section 6 below.

3. Payment. You will be charged the fee and any applicable taxes for each subscription when you initially sign up and on the first day of each renewal period (either monthly, annually or another billing cadence). To avoid being charged for an additional renewal period you must cancel your subscription in accordance with Section 6 below. If your payment is declined for any reason your subscription will be immediately terminated.

4. Automatic Renewal. Your subscription will renew automatically unless you cancel. This means that on the day after your subscription period ends a new subscription with the same terms, duration becomes effective and your payment method is debited for the cost of the subscription and any applicable taxes. Renewal rates for introductory or special sale priced subscriptions will be the full standard subscription price as disclosed at the time of purchase.

5. Promotional Period. If your subscription includes a promotional rate, you will be charged the promotional rate for the relevant number of subscription periods and upon completion of that period, your subscription will continue to automatically renew at the full rate. To avoid being charged the full rate, you must cancel in accordance with Section 6 before the promotional period ends. A promotional period is only granted once to any Customer. If you set up a second account with a different email address you shall not be entitled to any additional promotional period.

6. Cancelling. You may cancel your subscription at any time on or before the last day before the end of your current subscription period. Cancellation is effective at the end of your current subscription period. To cancel you must login to your account, and complete a cancellation request. A confirmation note will be delivered to the email address on record.

7. No Refunds. If you cancel your subscription during the subscription period you will not be refunded the fee for the subscription period then in process. YOU ACKNOWLEDGE THAT YOU MUST CANCEL YOUR SUBSCRIPTION IN ACCORDANCE WITH SECTION 6 ABOVE IN ORDER TO AVOID THE FEE FOR THE NEXT UPCOMING SUBSCRIPTION PERIOD.

8. Changes to these Subscription Terms. If we make changes in the Subscription Terms and Conditions, we will tell you about the changes as soon as reasonably possible. When such changes are made, we will make a copy of the new Terms available to you on our Site. If we reasonably believe a change is unfavorable to you, we will give you prior notice of at least 30 days before any change takes effect.

9. Termination of Subscription Program. The Star reserves the right to suspend or terminate your subscription at any time for any reason or for no reason, in our sole discretion. The Star also reserves the right, in our sole discretion to suspend or terminate any subscription program at any time. In the event the Star terminates the subscription we will either (at our sole election) : (a) allow your subscription to continue to the end of the then-current subscription period or (b) refund to you a prorated portion of the subscription fees you previously paid for that subscription period.

10. Limitation of Liability. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW NEITHER WE, NOR OUR AFFILIATES OR ANY OF OUR OR THEIR RESPECTIVE DIRECTORS, MANAGERS, OFFICERS, EMPLOYEES, AGENTS, OR CONTENT OR SERVICE PROVIDERS SHALL BE LIABLE FOR ANY INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES ARISING FROM OR DIRECTLY OR INDIRECTLY RELATED TO THE USE/MISUSE OF, OR THE INABILITY TO USE, THE SUBSCRIPTION OR THE SITE OR THE CONTENT, MATERIALS AND FUNCTION RELATED THERETO, INCLUDING, WITHOUT LIMITATION, LOSS OF REVENUE, OR ANTICIPATED PROFITS, OR LOST BUSINESS, DATA OR SALES, OR COST OF SUBSTITUTE SERVICES, EVEN IF WE OR OUR REPRESENTATIVE OR SUCH INDIVIDUAL HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATION OR EXCLUSION OF LIABILITY SO SOME OF THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.

IN NO EVENT SHALL OUR NOR ANY OF OUR AFFILIATES NOR ANY OF OUR OR THEIR RESPECTIVE DIRECTORS, MANAGERS, OFFICERS, EMPLOYEES, AGENTS, OR CONTENT OR SERVICE PROVIDERS TOTAL LIABILITY TO YOU FOR ALL DAMAGES, LOSSES, AND CAUSES OF ACTION (WHETHER IN CONTRACT OR TORT, INCLUDING, BUT NOT LIMITED TO, NEGLIGENCE OR OTHERWISE) ARISING FROM THE TERMS OR YOUR USE OF THE SUBSCRIPTION EXCEED, IN THE AGGREGATE, THE AMOUNT YOU ACTUALLY PAID DURING THE 3 MONTHS PRIOR TO YOUR CLAIM.

11. Electronic Notifications. You consent to receive notifications from us or from The Star electronically to the email address you provide to us. You agree that all notices, disclosures, and other communications that we provide to you electronically satisfy any legal requirement that such communications be in writing, or be delivered in a particular manner. You agree that you have the ability to store such electronic communications such that they remain accessible to you in an unchanged form.

12. Severability. If any section of these Subscription Terms is deemed invalid, void, or for any reason unenforceable, that section will be deemed severable and will not affect the validity and enforceability of any remaining sections.

13. Entire Agreement. The Subscription Terms, the Terms of Use of the Site, the Privacy Policy, and any other special terms constitute the sole and entire agreement between you and the Star and supersede all prior and contemporaneous understandings, agreements, representations, and warranties, both written and oral.
